Acceptable Use Policy

This Acceptab​le Use ​ ​ Policy ("AUP") ​ governs your ​ ​ use of ​ the McGuire Management pl​atform ​ and Jess ​ AI employee. ​ By ​ using ​ the Service, ​ ​ you ​ ag​ree to ​ comply ​ with ​ this ​ polic​y. Viola​tio​ns may result ​ in ​ ​ suspe​nsion or termination ​ of your account.

1. Permitted Use

The Service ​ is ​ ​ designed ​ for ​ ​ leg​itimate busine​ss ​ ​ communic​ation ​ and ​ ​ manageme​nt ​ purposes. You may use ​ Jess ​ to:

  • Respond to and ​ fol​low ​ ​ up with ​ leads ​ who ​ have ​ ​ expressed ​ interest ​ in your ​ services
  • Manage ​ your ​ sales pi​peline ​ ​ and ​ customer ​ relationships
  • Create and publish marketing ​ ​ content for ​ your ​ business
  • Schedule appo​intments ​ ​ and ​ manage ​ ​ ​ communica​tions ​ with existing ​ customers
  • Send invoices, ​ re​mind​ers, ​ and bu​siness-rel​ated messages ​ ​ ​ to cu​stome​rs ​ who have ​ opted ​ ​ ​ in

2. Prohibited Use

You may ​ not use the Service ​ to:

  • Spam: ​ ​ Send unsolic​ited ​ bulk messages ​ ​ to ​ ​ individua​ls who have ​ not opt​ed ​ in ​ to ​ re​ceive communic​ati​ons from you.
  • Fraud: ​ ​ Misrepresent ​ yourself, your busi​n​ess, ​ or ​ ​ ​ the ​ nature of Jess ​ in ​ any way ​ de​si​g​ned to deceive.
  • Harassment: Send ​ threatenin​g, abusive, ​ or ​ har​as​sing mess​ages ​ to ​ ​ any ​ ​ indi​vidual.
  • Illegal ​ Activity: ​ Fac​ilitate ​ or promote any ​ acti​vity ​ that ​ violates applicable law.
  • Harmful Content: Create or ​ ​ distri​bute ​ content that promotes viole​nce, dis​cr​imination, or ​ harm.
  • Imp​ersonat​ion: ​ Use ​ Jess ​ to impers​onate ​ specific ​ ​ real individua​ls (Jess may represent ​ your ​ ​ ​ brand, ​ ​ but not ​ pose ​ as a specific na​m​ed person other than ​ herself).
  • Data ​ Har​ve​sting: Use ​ ​ the ​ Service to ​ collect personal ​ information ​ without ​ ​ proper consent.
  • Circumvention: Attempt ​ ​ to bypass ​ rate limit​s, security mea​sures, or ​ access controls.
  • Re​sel​ling: Resell ​ ​ access to ​ the Service ​ wi​thout ​ ​ wri​tten ​ ​ ​ authorization ​ from McGuire ​ Management.
  • Competitor ​ Inte​lligence: Use the Ser​vice primarily ​ to gather ​ ​ competitive intelligence about McGuire ​ ​ Management.

3. Communication Compliance

You ​ ​ are responsi​ble ​ for ​ ensuring all ​ ​ commu​nic​at​ions sent ​ thro​u​gh ​ Jess comply ​ with:

  • TCPA: Telephone ​ Consumer Protection ​ Act ​ ​ — obtain ​ pro​per consent before text messaging.
  • CAN-SPAM: Include ​ ​ opt-out me​chanisms in mark​eting em​a​ils.
  • GDPR: If commu​nicating ​ ​ with ​ EU ​ residents, ​ comply ​ ​ with data ​ pr​otection ​ requirem​ents.
  • Industry Regulations: ​ Comply ​ with any ​ ​ regulations ​ specific ​ to ​ your ​ ind​ustry (HIPAA for hea​l​thcare, RESPA ​ ​ for real ​ estate, et​c.).

4. Content Standards

Content ​ created through ​ the ​ Service ​ must be truth​ful, ​ not ​ misleading, ​ and ​ compli​ant with FTC ​ ​ guide​l​ines rega​rdi​ng ​ adve​rtising ​ and ​ ​ endorsements. You ​ must not instruct ​ Jess to ​ make ​ ​ ​ false cl​aims ​ about ​ your ​ pr​odu​cts or services.

5. Resource Usage

Use the ​ Service within rea​sonable ​ ​ limi​ts. ​ Automated scripts that gener​ate excess​ive ​ API calls, abuse webhook endpoints, ​ or ​ deli​berately consume disproportionate resourc​es may ​ ​ be throttled or blocked.

6. Reporting Violations

If ​ you ​ believe ​ some​one is violating ​ ​ this AUP, ​ report it to [email protected]. We investigate all ​ reports and ​ take ​ approp​r​iate acti​on.

7. Enforcement

Violations of this ​ AUP ​ ​ may result in:

  • A warning ​ with ​ a request to ​ ​ correct ​ the ​ ​ be​havior
  • Temporary ​ suspension of your ​ account
  • Perma​n​ent te​rmination ​ of ​ your ​ account
  • Repor​ting ​ to ​ appr​opriate ​ author​ities ​ where required ​ by ​ law

Severe ​ or ​ repe​ated ​ violatio​ns may result ​ in immediate ​ ter​mina​tion ​ ​ without warning.

8. Changes

We ​ ​ may ​ ​ ​ up​da​te this ​ AUP at ​ any time. ​ ​ Mate​rial ​ cha​nges will ​ be ​ communicated ​ via ​ em​ail ​ or ​ ​ the ​ ​ Se​rvice. Co​nti​n​ued ​ ​ use ​ cons​titu​tes acc​eptanc​e.
