This Acceptable Use Policy ("AUP") governs your use of the McGuire Management platform and Jess AI employee. By using the Service, you agree to comply with this policy. Violations may result in suspension or termination of your account.
1. Permitted Use
The Service is designed for legitimate business communication and management purposes. You may use Jess to:
- Respond to and follow up with leads who have expressed interest in your services
- Manage your sales pipeline and customer relationships
- Create and publish marketing content for your business
- Schedule appointments and manage communications with existing customers
- Send invoices, reminders, and business-related messages to customers who have opted in
2. Prohibited Use
You may not use the Service to:
- Spam: Send unsolicited bulk messages to individuals who have not opted in to receive communications from you.
- Fraud: Misrepresent yourself, your business, or the nature of Jess in any way designed to deceive.
- Harassment: Send threatening, abusive, or harassing messages to any individual.
- Illegal Activity: Facilitate or promote any activity that violates applicable law.
- Harmful Content: Create or distribute content that promotes violence, discrimination, or harm.
- Impersonation: Use Jess to impersonate specific real individuals (Jess may represent your brand, but not pose as a specific named person other than herself).
- Data Harvesting: Use the Service to collect personal information without proper consent.
- Circumvention: Attempt to bypass rate limits, security measures, or access controls.
- Reselling: Resell access to the Service without written authorization from McGuire Management.
- Competitor Intelligence: Use the Service primarily to gather competitive intelligence about McGuire Management.
3. Communication Compliance
You are responsible for ensuring all communications sent through Jess comply with:
- TCPA: Telephone Consumer Protection Act — obtain proper consent before text messaging.
- CAN-SPAM: Include opt-out mechanisms in marketing emails.
- GDPR: If communicating with EU residents, comply with data protection requirements.
- Industry Regulations: Comply with any regulations specific to your industry (HIPAA for healthcare, RESPA for real estate, etc.).
4. Content Standards
Content created through the Service must be truthful, not misleading, and compliant with FTC guidelines regarding advertising and endorsements. You must not instruct Jess to make false claims about your products or services.
5. Resource Usage
Use the Service within reasonable limits. Automated scripts that generate excessive API calls, abuse webhook endpoints, or deliberately consume disproportionate resources may be throttled or blocked.
6. Reporting Violations
If you believe someone is violating this AUP, report it to [email protected]. We investigate all reports and take appropriate action.
7. Enforcement
Violations of this AUP may result in:
- A warning with a request to correct the behavior
- Temporary suspension of your account
- Permanent termination of your account
- Reporting to appropriate authorities where required by law
Severe or repeated violations may result in immediate termination without warning.
8. Changes
We may update this AUP at any time. Material changes will be communicated via email or the Service. Continued use constitutes acceptance.
