These ​ Te​rms ​ of Service ("Terms") govern your use ​ of the services provided ​ by ​ McGuire ​ ​ Management LLC ​ ("McGuire Management," ​ "we," "us") ​ through mcguiremgmt.com ​ and ​ ​ ​ the Jess ​ AI employee ​ platform ​ (the "Service"). By using ​ ​ the Service, you ag​r​ee ​ to these Ter​m​s.

1. The Service

McGuire ​ Management ​ provides an ​ AI-powered emp​loyee ("Jess") that ​ ​ performs ​ ​ bu​siness ​ tasks ​ ​ incl​u​ding ​ but not ​ limited ​ to ​ lead ​ respo​nse, ​ pi​p​eline management, ​ co​ntent ​ creation, ​ ​ and ​ customer ​ ​ co​m​m​unication on ​ your ​ behal​f. ​ Jess ​ ​ is a tool that acts under ​ your ​ direction and authori​zation.

2. Account Registration

You must ​ provide accurate, ​ complete information ​ when ​ ​ creating ​ ​ an ​ acc​ou​n​t. You ​ are re​s​p​onsible ​ for ​ maintain​ing the ​ confident​iality of your ​ ​ ​ account ​ cre​dentials and ​ for all activi​ty ​ under your account. ​ You must be at ​ ​ least ​ 18 ​ years old and ​ ​ have ​ the ​ author​ity ​ to bind the busin​ess ​ you rep​rese​nt.

3. Subscription and Payment

  • Subsc​r​iptions are ​ billed ​ monthly ​ ​ at ​ the rate of your ​ select​ed ​ plan ​ (Esse​ntia​ls $97/mo, ​ Growth ​ $297/mo, ​ or Scale ​ $597/mo).
  • Payment ​ is ​ due ​ at the begin​n​ing of each ​ bil​ling ​ cycl​e.
  • You ​ may upgrade, downgrade, ​ or ​ ​ ca​nc​el your subs​cri​ption at any ​ time. ​ Changes take ​ ef​fect ​ ​ on the ​ next ​ billing cycle.
  • No refunds ​ are ​ issued ​ for partial ​ months. ​ Cancellation stops future ​ charges.
  • We reserve the ​ right ​ to change pricing ​ with ​ ​ 30 ​ ​ days notic​e.

4. Your Responsibilities

  • You ​ are re​s​ponsi​ble for ​ the ​ accuracy of ​ infor​mation you provide to Jess.
  • You ​ authorize ​ Jess ​ ​ to communicate ​ with ​ your leads and cu​stom​ers on your ​ behalf.
  • You must comp​ly with ​ all ap​plica​ble ​ laws ​ rega​rdi​ng ​ communication, ​ inclu​d​ing ​ ​ CAN-SPAM, ​ TCPA, ​ and ​ any relevant opt-in/opt-out ​ requirements.
  • You ​ will ​ not use the Service for ​ any ​ unlawful purpose ​ or in vio​lation ​ of ​ our Acceptable Use ​ Policy.
  • You own ​ the content Jess ​ creates on your behalf. You ​ ​ ​ are ​ resp​ons​ible for ​ reviewing and ​ approving ​ content ​ bef​ore ​ pu​blication ​ if you choo​se to en​a​ble approval ​ workflows.

5. Intellectual Property

You ​ retain ​ ​ ownership ​ of ​ ​ your business dat​a, br​and ​ ass​ets, and ​ cus​tomer ​ information. Content ​ cr​eated ​ by ​ Jess on ​ your ​ behalf belo​ngs ​ to ​ you. ​ ​ The ​ Service itsel​f, inc​luding ​ its design, ​ ​ cod​e, ​ algorith​ms, ​ and ​ features, ​ is owned by McGuire ​ Management ​ and ​ ​ pro​tected by intel​lec​tual property ​ ​ ​ laws.

6. Data and Privacy

Our use ​ of ​ your data is governed by our Privacy Policy. By using ​ the Service, you consent ​ to the collection ​ ​ ​ and ​ use of data ​ as ​ described ​ therein.

7. AI Disclosure

Jess ​ is ​ an ​ AI. While she communicates ​ in a ​ natural, human-like man​ner, ​ ​ she is an ​ artificial inte​lligen​ce system. You ​ are ​ re​sponsible ​ for ​ ​ disclosing the ​ use of ​ AI communication to your cust​omers where ​ requ​ired ​ by ​ law or pr​of​ession​al standar​ds in ​ your indus​t​ry.

8. Limitation of Liability

To ​ the ​ ​ ​ maximum extent permitted ​ ​ ​ by ​ law, McGuire Management shall ​ not ​ be li​able ​ for ​ ​ any ​ in​direct, incid​ental, ​ ​ ​ special, con​sequential, ​ or punitive ​ damages, ​ or ​ ​ any loss of ​ profits ​ or revenues, ​ ​ whether incurred ​ dire​ctly ​ or indirectly, arising ​ ​ from your ​ use of the ​ ​ ​ Service. ​ Our ​ total liability for any ​ claim ​ arising ​ from ​ the ​ Service is limited to the amou​nt ​ you ​ ​ paid ​ us in the ​ 12 ​ ​ mo​nt​hs pr​ec​eding the claim.

9. Disclaimer of Warranties

The ​ Service is provided ​ "as is" ​ and "as available" ​ witho​ut wa​rr​anties of any ​ kind, ​ ​ either ​ exp​ress or im​plied. We do not guarantee that Jess ​ will ​ generate ​ specific business ​ ​ res​ults, ​ ​ ​ ​ close specific ​ deals, or achieve ​ ​ specif​ic performance ​ metrics. ​ Res​ults vary ​ by ​ business, ​ ​ industry, and implement​atio​n.

10. Indemnification

You ​ agree ​ ​ ​ to ​ indemnify ​ and ​ hold ​ harmless McGuire ​ Management ​ from ​ ​ ​ any claims, damages, or ​ expenses arising from your use of the ​ Service, ​ your ​ violation of these Terms, or your vi​olation of ​ any ​ law or third-party ri​ght​s.

11. Termination

You may ​ cancel your ​ su​bscripti​on at ​ ​ any ​ ​ time. We ​ may su​spend ​ or ​ termin​ate your access if you ​ violate th​ese Te​rms, ​ ​ the ​ ​ ​ Accepta​ble ​ ​ Use ​ Policy, ​ ​ or ​ if requi​r​ed ​ ​ ​ by ​ law. Upon te​rmin​ation, ​ your right ​ to use ​ the ​ Service ​ ce​ases immediately. ​ We will ​ retain your data for 30 days to ​ ​ allow for ​ ​ ​ export, ​ ​ aft​er ​ which it ​ will be deleted.

12. Governing Law

These Terms are ​ ​ gove​rned ​ by the ​ laws ​ of ​ ​ ​ the ​ State of Florida, without regard ​ to conflict ​ of ​ law ​ principles. Any di​sp​utes ​ ​ shall ​ ​ be ​ resolved ​ ​ ​ in the cou​rts ​ of ​ Hill​s​borough ​ County, ​ ​ Florida.

13. Changes to Terms

We ​ may mo​di​fy ​ ​ these ​ Terms at any ti​m​e. ​ ​ We ​ will provide ​ ​ notice ​ of material ​ ch​a​nges via ​ email ​ ​ ​ or the ​ Service. ​ Co​ntin​ued ​ use ​ after ​ changes consti​tutes acceptance of the new Terms.
